Update:  Man faces felony animal cruelty charge

A Lincoln County man who was arrested in April on a misdemeanor charge of animal cruelty is scheduled to go on trial Tuesday, and he will face a felony charge instead.

Lincoln County Sheriff's officials have said that the man, Timothy Scott Putt of Denver, grabbed a Jack Russell terrier by the hind legs and slammed it on the pavement twice, killing the animal.

Putt went before a grand jury June 26, the district attorney's office said, and the charge was changed to felony animal cruelty then.


The prosecutor, assistant district attorney Kay Killian, said the maximum punishment for the felony charge in this case would be four to six months probation, or six to eight months if there are aggravating circumstances. The maximum punishment for the misdemeanor charge would have been 120 days, jail or probation.


According to state law, a misdemeanor charge of animal cruelty alleges a person intentionally
harmed or killed an animal. A felony charge alleges the person caused the harm or death out of malice.

Have a call in to ADA Killian: she is the one handling: that is her NC county.

My added opinion:  this should goto Grand Jury to get a true bill on Felony charges-I am
asking her what she is planning to do.. Now: having said that:I spoke directly with the magistrate who was the one who issued the misdemeanor:

Here are the LEGAL facts of the case:

Timothy Scott Putt and the arresting officer were before the magistrate: 
Putt stated the following:

His dog was in Heat (he admitted he owned the dog)..wandered over to the next yard.  Neighbor got all upset, screaming.  He (Putt) went over to the neighbor: picked up the Jack and got Bit.  He then bashed the dog (he admitted it) several times on the concrete, thereby causing said death of the Jack.

Now, under LEGAL interpretation of the Felony Animal Cruelty charges:  there is the word "maliciously".... let me expound basic legal brief on this word:

He had No malice or intent to originally go over and kill the dog..the killing was a result "of the heat of the moment" (as they say in law to mitigate charges).  This "heat of the moment" brought the Felony down to Misdemeanor.  He had no precognitive desire to kill the dog.  Or did he??  hmmmmmmm.

I also ask: IF he was bit...why no pictures??? Did the officer state he saw the "bite-mark"???
Did dog have rabies shots UTD???  If no records produced: dog must be beheaded and sent to State lab for Rabies testing. Under NC law: ALL dog bites must be reported! Ironically: the area where Putt Lives? Well,it has had rabies cases!!!!!

However, upon longer thought: I said, why does not Ms.Killian (ADA who IS handling the case) - bring in to matter-going to Grand jury to see if she can get a true bill to up the misdemeanor charge to Felony status.  Since,really this is all a matter of interpretation:

I also conjectured: Putt, knowingly admitted this dog was in heat and LET IT ROAM.  He is, therefore, also to be charged with misdemeanor neglect.  Now, this was a deliberate act.  He knew animal was in heat.  He did not want breeding to take place.  So why the hell was dog running loose??? (also: was this in city limits with a leash law?  well, another count if it is!)..

Probable reason for delay: ADA Ms.Killian IS mulling over whether to go to Grand Jury ..or not.  Support her!!!!!!!  

Putt's trial is scheduled for July 26, 2006.

Do not condemn her.  She is going by law: but, please bring all the forementioned facts to her attention!

Also: I would (personal opinion) bring in as witness to dog abuse case:  Ms.Karen Eileen Childress (see below 3/20/06).  Under law, the deliberate strangulation by Putt upon her with a plastic bag is not admissable in the animal court case.  BUT: her testimony stating Putt has a deliberate, uncontrolled severe anger personality-based on her knowledge and experience with him IS admissable and will serve to bolster the felony upgrade.  Grand Jury MUST HEAR THAT Putt has a demonstrated proclivity to dangerous actions resulting in bodily harm...to both animals and humans.

BE STRONG ... Logic goes a long way in this case.My opinion:Putt is a "loose cannon"..just waiting to explode into heinous life-taking criminal activities down the road.Which shall it be
this time: more dogs,children or more women????  (since the plastic bag did not work..maybe a gun will the next time)

Lincoln County Sheriff's deputies arrested a Denver man on an animal cruelty charge on April 14, 2006 after they say he killed a dog.

Deputies say Timothy Scott Putt grabbed the Jack Russell terrier by the hind legs and slammed the animal onto the concrete, which killed it, according to a release from the agency. The dog did not belong to Putt. A judge set Putt's bond at $3,000. It was unknown this morning whether he had been released on bond from the Lincoln County jail.
